Severance clause, тъй като нямам ни най- малко познания в юридическата сфера, а и не мога да открия точни юридически названия за тях на БГ(нарочно поствам целите точки за да се разбере точния смисъл).

1.Circumvention
The company is entitled to circumvent any defect which may arise if the cost
involved in rectifying the defect itself is disproportionate and the run-time and response time of the Software does not suffer significantly as a result of the circumvention measures.

2.Defects in title
The company warrants that the contractual Software does not infringe any third-party rights. A defect in title exists where the company is unable to effectively grant the rights necessary for contractual use to the Licensee.

3.Severance clause

Where a provision of this Contract is or becomes invalid, the remaining provisions of the Contract shall retain their validity. The contracting parties agree to replace the invalid provision with a valid one which best corresponds to the economic purpose of the contracting parties. The same applies in the case of an omission in the Contract.

Severance clause - клауза за разтрогване на договора. А доколкото чета (набързо) - думата circumvention съвсем не е употребена на място.

Circumvention е употребено в смисла на by-pass или workaround. Сиреч, Company може технически да заобиколи дефекта вместо да го поправя, при условие че заобикалянето не би сериозно нарушило употребата на софтуера.

Defects in title се отнася към правата, интелектуалната собственост върху софтуера. Сиреч, Company гарантира, че софтуерът не нарушава интелектуалните права на трети лица.

Severance clause означава, че ако някоя от клаузите се окаже невалидна, то това не би повлияло на остатъка от договора. Невалидната клауза следва да замести от такава, която най-вече отговаря на договорната цел.
